Article 1 - Definitions

In these terms and conditions, the following definitions shall apply:

1. Trader: BW Import EU bv, Battelsesteenweg 471, B-2800 Mechelen, Belgium,

2. Consumer: the natural person who enters into an agreement with the entrepreneur for purposes outside his trade, business, craft or profession.
3. Distance contract: a contract concluded via the webshop, without the physical presence of the parties.
4. Right of withdrawal: the consumer's right to dissolve the contract within 14 days.

Article 2 - Applicability

1. These General Terms and Conditions apply to all offers and agreements between BW Import EU bv and the consumer.
2. By placing an order, the consumer agrees to these terms and conditions.

Article 3 - Offer

1. All products on the webshop are described as accurately as possible.
2. Prices shown include VAT and exclude any shipping costs unless otherwise stated.
3. Errors in product descriptions or prices cannot lead to a legal claim, but the consumer will be informed.

Article 4 - Order and agreement

1. An order is established once the consumer accepts the offer and payment is completed.
2. BW Import EU bv will confirm the order by e-mail.

Article 5 - Prices and payment

1. Prices quoted include VAT.
2. Shipping costs will be listed separately at checkout.
3. Payment can be made via the payment methods indicated on the webshop.

Article 6 - Delivery

1. Orders are shipped to the address provided by the consumer.
2. Delivery takes place within Belgium, the Netherlands, Luxembourg and possibly other EU countries.
3. The delivery time is indicative and non-binding; delay does not entitle you to compensation.

Article 7 - Right of withdrawal

1. The consumer can dissolve the agreement within 14 days of receiving the product without giving reasons.
2. To exercise the right of withdrawal, download here the withdrawal form and return it completed by e-mail to contact@bwimport.be .
3. The product must be returned unused, undamaged and (if reasonably possible) in its original packaging.
4. Return shipping costs shall be borne by the consumer, unless the product was delivered incorrectly or damaged and unless otherwise stated.
5. Products that are personalised or unsuitable to return for hygienic reasons are excluded from the right of withdrawal.

Article 8 - Refund in case of withdrawal

1. Upon receipt and verification of the return, BW Import EU bv will refund all payments, including the original shipping costs (unless the consumer chose another shipping method).
2. Refunds will be made within 14 days of receipt of the return.

Article 9 - Exchanges

1. Consumers can exchange a product for another product, for example a different size or colour, provided the product is unused and in its original packaging.
2. Exchanges can be made by contacting contact@bwimport.be.
3. The cost of return for exchange shipment shall be borne by the consumer, unless otherwise agreed.
4. Once the exchanged product is received and checked by BW Import, the new product will be shipped.

Article 10 - Warranty and liability

1. The statutory 2-year warranty applies to all products. This does not cover wear and tear or damage caused by misuse.
2. BW Import EU bv shall not be liable for indirect or consequential damage; liability is limited to the amount of the order.
3. Liability for intent or gross negligence cannot be excluded.

Article 11 - Complaints

1. Complaints about products or delivery should be submitted within 8 days, fully and clearly described, via contact@bwimport.be.
2. BW Import EU bv will respond to complaints within 14 days.

Article 12 - Other provisions

1. Belgian law applies to all agreements between BW Import EU bv and the consumer. Any dispute arising in connection with the validity, interpretation or performance of the agreement and the invoice can only be settled before the Courts of Antwerp, Mechelen division and the claim. Justice of the Peace of the Canton of Mechelen, depending on the extent of the claim.
2. If any provision in these General Terms and Conditions is found to be void or voidable, the remaining provisions shall remain in full force and effect.
